Visit Our Directories, LLC ("Company," "we," "us," or "our"), operator of the Visit Our Church website (the "Service"), respects the intellectual property rights of others and expects its users to do the same. This DMCA Notice describes the procedures by which copyright owners may report alleged infringement and by which users may respond, in accordance with the Digital Millennium Copyright Act of 1998, 17 U.S.C. § 512 (the "DMCA").

2. Scope

This Notice applies to all content made available on the Service, including church Listings, photographs, logos, sermon media, event descriptions, reviews, and any other material submitted by users or church representatives. Content currently displayed on the Service consists of illustrative samples.

3. Designated Copyright Agent

Notices of claimed infringement should be directed to the Company's designated agent:

Visit Our Directories, LLC — Attn: Copyright Agent. The agent's official email and mailing addresses will be published here upon registration with the U.S. Copyright Office.

4. Filing a Notice of Infringement

To be effective under 17 U.S.C. § 512(c)(3), a notice must be in writing and include substantially the following:

  1. (a) a physical or electronic signature of the copyright owner or a person authorized to act on the owner's behalf;
  2. (b) identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notice, a representative list of such works;
  3. (c) identification of the allegedly infringing material, with information reasonably sufficient to permit us to locate it, such as the specific URL;
  4. (d) your name, mailing address, telephone number, and email address;
  5. (e) a statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law; and
  6. (f) a statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner's behalf.

5. Our Response to Notices

Upon receipt of a notice that substantially complies with the requirements above, the Company will act expeditiously to remove or disable access to the identified material and will make reasonable efforts to notify the user or church representative who posted it. Notices that fail to substantially comply may not be acted upon.

6. Filing a Counter-Notification

If you believe material you posted was removed or disabled as a result of mistake or misidentification, you may submit a counter-notification under 17 U.S.C. § 512(g)(3) containing substantially the following:

  1. (a) your physical or electronic signature;
  2. (b) identification of the material that was removed or disabled and the location at which it appeared before removal;
  3. (c) a statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification;
  4. (d) your name, address, and telephone number; and
  5. (e) a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which the Company may be found), and that you will accept service of process from the person who provided the original notice or that person's agent.

7. Restoration of Material

Upon receipt of a valid counter-notification, the Company will forward a copy to the original complaining party. The removed material may be restored in not less than ten (10) nor more than fourteen (14) business days following receipt, unless the complaining party first notifies us that it has filed an action seeking a court order to restrain the alleged infringement.

8. Misrepresentations

Under 17 U.S.C. § 512(f), any person who knowingly and materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys' fees. Before submitting a notice, consider whether the use may be authorized or qualify as fair use.

In appropriate circumstances, the Company will terminate the accounts and Listing privileges of users and church representatives who are determined to be repeat infringers.
